Terms of Service

These terms govern the MarkRelay website, customer portal, purchases, license delivery, and support. The self-hosted MarkRelay application runs in the customer's Cloudflare account; it is not a hosted mailbox service operated by MarkRelay.

1. Acceptance and eligibility

By creating an account, placing an order, or using this website, you agree to these terms and the license terms presented for the product you purchase. You must be able to enter a binding contract and, when acting for an organization, have authority to bind that organization.

2. Customer account

You are responsible for accurate account information, safeguarding credentials, and activity under your account. Notify us promptly if you believe an account or order has been compromised. We may suspend website access to protect customers, investigate fraud, or enforce these terms.

3. Products and license scope

  • Deploy License. A non-source production distribution for deployment in your Cloudflare account, with lifetime use and updates for the licensed edition. Readable source code and rights to redistribute the product are not included.
  • Source License. The production product and complete source workspace, with modification, white-label, commercial-use, and redistribution rights as defined in the Source License delivered with the purchase.

The specific license agreement delivered with a product controls if it conflicts with this website summary. You may not obtain, copy, share, resell, or bypass access to software outside the rights of your purchased license.

4. Self-hosted deployment responsibilities

You are responsible for:

  • your Cloudflare account, plan, billing, account approvals, domains, DNS, Email Routing, outbound sending access, and service quotas;
  • deployment, administrator access, secrets, upgrades, backups, monitoring, retention, security, and incident response;
  • the lawfulness, accuracy, and security of mailbox and recipient data in your deployment; and
  • compliance with anti-spam, privacy, consumer-protection, export, and other laws that apply to your messages and users.

Cloudflare and recipient mail providers are independent third parties. MarkRelay does not control their availability, limits, pricing, delivery decisions, or policy enforcement and does not guarantee inbox placement.

5. Acceptable use

You may not use MarkRelay to send unlawful, deceptive, abusive, or unsolicited messages; distribute malware; impersonate others; harvest addresses; violate privacy or intellectual-property rights; evade suppression or unsubscribe requests; interfere with systems; or breach Cloudflare's or another provider's policies. You must maintain a lawful basis or valid consent where required and promptly honor opt-outs, complaints, and suppression records.

6. Orders, taxes, and refunds

Prices are shown in USD unless stated otherwise. Cloudflare, domains, taxes, and third-party services are not included. Payments are processed by Stripe. You are responsible for applicable taxes except taxes on our income.

You may request a refund within 30 days of purchase with a short explanation. A Source License is not refundable after source materials have been delivered. Refunds are reviewed for compliance with these terms, fraud prevention, and applicable law. Contact us before purchase if you require a different contractual commitment.

7. Updates and support

Lifetime updates mean generally released updates for the licensed MarkRelay edition while that edition is maintained. You decide when to apply an update. Custom code, third-party migrations, Cloudflare platform changes, emergency operations, and bespoke development are not automatically included. Guided initial deployment and support do not transfer operation of your Cloudflare account to us.

8. Customer content and privacy

You retain rights in content you submit to the website and data stored in your deployment. You grant us only the rights reasonably necessary to process website accounts, orders, support requests, and materials you intentionally send us. The Privacy Policy describes website data processing. We do not claim ownership of mailbox data stored only in your self-hosted deployment.

9. Intellectual property

MarkRelay, the website, documentation, software, and related branding are protected by intellectual-property laws. Except for rights expressly granted by your license, all rights are reserved. Feedback may be used to improve the product without an obligation to you, provided we do not publish your confidential information.

10. Disclaimer and limitation of liability

To the maximum extent permitted by law, the website, software, documentation, and support are provided “as is” and “as available,” without warranties of uninterrupted operation, deliverability, fitness for a particular purpose, or non-infringement. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost messages, loss of data, or third-party service failures. Any aggregate liability is limited to the amount you paid us for the product giving rise to the claim during the 12 months before the event, unless applicable law requires more.

11. Changes and termination

We may update these website terms prospectively by posting a revised version and date. Changes do not retroactively reduce rights already granted under a paid software license. We may terminate access to the website or support portal for material breach, fraud, security risk, or unlawful use. Terms that by nature should survive will survive.
